Attendance

The New York State Education Law permits legal absences from school for the following reasons: sickness, sickness or death in the family, religious observances, required presence in court, religious instruction, and impassable roads or weather making travel unsafe. A note explaining the reason for absence is required on the day the child returns to school. Whenever possible, parents should advise the school by telephone of the child’s absence. Also, a note explaining tardiness is required for all students.

Protection of Pupil Rights Amendment (PPRA)

PPRA governs the administration to students of a survey, analysis, or evaluation that concerns one or more of the following eight protected areas: (1) Political affiliations or beliefs of the students or parents; (2) Mental or psychological problems of the student or the student's family; (3) Sex behavior or attitudes; (4) Illegal, anti-social, self-incriminating, or demeaning behavior; (5) Critical appraisals of other individuals with whom respondents have close family relationships; (6) Legally recognized privileged or analogous relationship, such as those of lawyers, physicians, and ministers; (7) Religious practices, affiliations, or beliefs of the student or parents; or (8) Income (other than that required by law to determine eligibility for participation in a program or for receiving financial assistance under such program).

Vocational Education

The school district cooperates with the Western Suffolk BOCES (Board of Cooperative Education Services). Under the program, juniors and seniors may attend the senior high school for half of each day and the vocational school for the remainder of the time.

Working Papers

The school district cooperates with the New York State Labor Department in issuance of working papers required by law for
students under the age of 18 who seek employment. Students may obtain working papers by contacting the Attendance Office in the high school.

To secure working papers, a student must:

  1. Obtain and fill out an application.
  2. Have a Certificate of Physical Fitness form signed by a school doctor or family physician.
  3. Submit proof of age. This can be done in the form of a birth or baptismal certificate, hospital record or passport.

State and Federal Regulations

RELEASE OF STUDENT INFORMATION/RECORDS

Under the federal law, No Child Left Behind, districts are required to release student information, including names, addresses and telephone numbers to military recruiters and officials of institutions of higher education (§9528 of the ESEA). Parents wishing to exercise an “opt-out” option must notify the Superintendent in writing.
Unless objection to any of the specific items of information is submitted in writing by parents or legal guardians, or by those students themselves who are 18 years of age and older, the district gives notice of intention to provide, release, or publish in the district newsletter, school or student newspapers, magazines, yearbooks or other publications, daily or weekly newspapers, athletic programs, musical or theatrical programs, and news releases, any and/or all of the following information pertaining to students as may be appropriate under the circumstances: name of student, names of parents, address, age, height, weight, grade, major field of study, participation in recognized school activities, extracurricular activities and sports programs, academic honors, achievements, awards, scholarships, and similar information. Under Title 45, U.S. Code, Part 99, Privacy Rights of Parents and Students, parents, or students 18 years of age or older, who do not wish the release of any of the above directory information must make a specific request in writing to the Superintendent of Schools by September 30, 2011. Failure to make such a request shall be deemed consent to release, provide, or publish the directory information during the school year.

 

NOTICE OF NON-DISCRIMINATION

SEXUAL HARASSMENT

The Babylon Board of Education recognizes that sexual harassment of students and staff is behavior that negatively impacts the school culture. The Board further recognizes that preventing and remedying sexual harassment in school is essential to ensure a healthy, nondiscriminatory environment in which students can learn and employees can work productively.
The Board is committed to providing an educational and working environment that promotes respect, dignity and equality, and that is free from all forms of sexual harassment on school grounds, school buses and at all school-sponsored activities, programs and events, including those that take place at locations outside the district.
Because sexual harassment can occur staff to student, staff to staff, student to student, male to female, female to male, male to male, or female to female, it shall be a violation of this policy for any student, employee, or third party (school visitor, vendor, etc.) to sexually harass any student or employee.
In order for the Board to effectively enforce this policy and take prompt corrective measures, it is essential that all victims of sexual harassment and persons with knowledge of sexual harassment report the harassment immediately. The district will promptly investigate all complaints of sexual harassment, either formal or informal, verbal or written. To the extent possible, all complaints will be treated in a confidential manner. Limited disclosure may be necessary to complete a thorough investigation. If, after appropriate investigation, the district finds that a student, an employee, or a third party has violated this policy, prompt corrective action will be taken in accordance with district policy and state law. All complainants and those who participate in the investigation of a complaint of sexual harassment have the right to be free from retaliation of any kind.

 

TITLE IX COMPLIANCE OFFICER

To ensure compliance with Federal and State regulations, the Babylon Union Free School District has identified the Assistant Superintendent, Mr. Travis Davey, as the Title IX Compliance Officer. Title IX deals with areas of discrimination involving age, sex, religion, national origin, and disability. Principals are designated Compliance Officers at their buildings.

 

SECTION 504/AMERICANS WITH DISABILITIES ACT

The Babylon School District does not discriminate on the basis of disabling conditions in the educational programs or activities it operates. It is required by Section 504 of the Rehabilitation Act of 1973 not to discriminate in such a manner. This policy of nondiscrimination includes the following areas: recruitment and appointment of employees; employment pay and benefits; counseling services for students; access by students to educational programs; course offerings and student activities. 504 Accommodation Plans are developed between parents and the school district.
The district has established Section 504 Committees in each of its schools and, in accordance with the requirements of Section 504, has identified Assistant Superintendent, Mr. Travis Davey, as the Section 504 Compliance Officer. If you believe your child has a disability that substantially limits a major life activity, please contact your child’s principal.
